The Secretary of State, in exercise of the powers conferred by section 231(2) and (3)(d) of the Education Reform Act 1988(1), hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Education (Inner London Education Authority) (Property Transfer) (Modification) Order 1996 and shall come into force on 29th March 1996.

(2) In this Order a reference to “the principal Order” is a reference to the Education (Inner London Education Authority) (Property Transfer) Order 1990(2).

Modification of the principal Order

2.  Condition A in article 2(2) of the principal Order shall apply in relation to the land known as “Divisional Office 2, 3–4 Picton Place, W1N 9HE” (transferred to the Council of the London Borough of Westminster by article 4 of, and Schedule 13 to, the principal Order) with the addition after the word “functions” of the words “or the provision of services in accordance with arrangements made with the Secretary of State under section 10 of the Employment and Training Act 1973(3) (careers services) or both”.

Explanatory Note

(This note is not part of the Order)

This Order modifies the Education (Inner London Education Authority) (Property Transfer) Order 1990 (“the principal Order”).

The principal Order transferred the property known as Divisional Office 2, 3–4 Picton Place W1 to the London Borough of Westminster subject to the condition (“Condition A”) that if it ceased before 1st April 2010 to be used wholly or mainly for the purposes of that council’s functions as the local education authority for its area it should be disposed of and the proceeds of sale, after specified deductions, distributed amongst all the inner London boroughs and (in their capacity as a local authority) the Common Council of the City of London. Condition A, as modified in relation to that property, now additionally refers to use for the provision of careers services in accordance with arrangements made with the Secretary of State under section 10 of the Employment and Training Act 1973.
