The Secretary of State, in exercise of the powers conferred on him by sections 1(1) and (2) and 24(1) and (3) of the Food and Environment Protection Act 1985(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Partial Revocation Order 1996 and shall come into force on 17th January 1996.

(2) In this Order, “the principal Order” means the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991(2).

Partial revocation

2.—(1) The principal Order is revoked so far as it designates any part of the areas set out in Schedule 1 to this Order.

(2) Part II of Schedule 1 to the principal Order shall be amended in accordance with Schedule 2 to this Order.

Article 2(1)

SCHEDULE 1

Dumfries and Galloway Region

The area of land within Nithsdale District comprising that part of the Parish of Kirkconnel bounded as follows:—

  • On the north from the point where the Polmarlach Burn meets the River Nith and running in an easterly direction by the River Nith to the point national grid reference NS693 130; then in a southerly direction to, and crossing the Road A76 at the point national grid reference NS695 125 and then continuing generally in a south-westerly direction through White Hill and south-westerly until the eastern boundary of the plantation at the point national grid reference NS682 102 north of Polnagrie Hill; then following generally the eastern and northern boundaries of the said plantation until it meets the Polmarlach Burn; and then following the said Burn until it meets the River Nith.

Strathclyde Region

The area of land within East Kilbride District comprising that part of the Parish of Avondale bounded as follows:—

  • On the north-west from the point national grid reference NS616 346 and continuing in a north-easterly direction to the summit of Graystone Hill and continuing easterly to the summit of Mill Rig; then again continuing easterly to the point national grid reference NS638 348; then south-easterly to the point national grid reference NS642 347; then north-easterly to the point national grid reference NS645 349; then westerly to the point national grid reference NS657 353; then continuing westerly by the Glengavel Water to the access road to Glengavel Reservoir on the Road A723; then in a south-easterly direction on said Road until it meets the boundary between East Kilbride District and Cumnock and Doon Valley District; then generally in a south-westerly direction by said boundary to the point national grid reference NS602 310; then in a north-easterly direction to the summit of Hart Hill; then again in a north-easterly direction to the summit of Little Hartmidden; then continuing in a north-easterly direction to the summit of Anderside Hill; then in a northerly direction to the point national grid reference NS616 346.

Article 2(2)

SCHEDULE 2

1.  For paragraph 2(d) of Part II of Schedule 1 to the principal Order there shall be substituted the following:—

(d)Those areas of land within Cumnock and Doon Valley District comprising those parts of the Parish of Muirkirk bounded as follows:—

(i)on the north, from the point national grid reference NS610 313 in an easterly direction, following the line of the boundary between Cumnock and Doon Valley District and East Kilbride District, to the summit of Bibblon Hill; then in a southerly direction to the point national grid reference NS663 315; then in a south-easterly direction to the Back Burn; then, following the line of the said Burn, to the point of intersection with a roadway at point national grid reference NS673 287; then, following the line of the said roadway, in a south-westerly direction to the point national grid reference NS669 285; then in a southerly direction to the point national grid reference NS670 285; then continuing in an easterly direction to the point national grid reference NS675 285; then in a southerly direction to Greenock Water at the point national grid reference NS674 284; then in a south-westerly direction, following the line of the said Greenock Water, to the point national grid reference NS670 282; then in a westerly and southerly direction following the northern and western boundaries of the Burnfoot Moor Plantation to the point of intersection with an unnamed burn at point national grid reference NS663 277; then in a generally northerly and westerly direction, following the line of the said burn, to its junction with the said Greenock Water; then in a westerly direction, following the line of the said Greenock Water, to its junction with Polkeboch Burn; then in a north-easterly direction following the said Polkeboch Burn to the point national grid reference NS647 293; then in a northerly direction to the point national grid reference NS647 310; then in a westerly direction to the point national grid reference NS641 311; then in a southwesterly direction to the point national grid reference NS629 289; then in a northerly direction to the point national grid reference NS630 294; then in a north-westerly direction to the point national grid reference NS610 313.

(ii)on the north from the point national grid reference NS672 324 in an easterly direction, following the boundary between Cumnock and Doon Valley District and East Kilbride District to the point of intersection with the boundary between Cumnock and Doon Valley District and Clydesdale District; then in a south-easterly direction, following the line of the last mentioned boundary, to the summit of Hare Craig; then in a southerly direction to the point national grid reference NS740 304; then in a generally westerly and southerly direction, following the line of the northern and western boundaries of a Plantation, to the point of intersection with Ponesk Burn at the point national grid reference NS724 299; then in a north-westerly direction, following the line of the said Ponesk Burn, to the point national grid reference NS716 306; then in a south-westerly direction to the point national grid reference NS715 305; then in a northerly direction to the point national grid reference NS712 312; then in a westerly direction to the point national grid reference NS705 314; then in a southerly direction to the point national grid reference NS705 310; then in a south-westerly direction to the point of intersection with the Road A723; then in a north-westerly direction, following the line of said Road to the point national grid reference NS689 316; then south-westerly to the point national grid reference NS684 310; then in a westerly direction to the point national grid reference NS674 311; then in a northwesterly direction to the point national grid reference NS673 316; then in a northerly direction to the point national grid reference NS672 324.

(iii)on the north from the point national grid reference NS651 263 on the River Ayr in a north-easterly direction, following the line of the said River Ayr, to the point national grid reference NS720 281; then in a south-easterly direction to the summit of Hawlk Hill; then in a south-easterly direction to the point national grid reference NS742 262; then in a generally south-westerly direction, following the line of the boundary between Cumnock and Doon Valley District and Clydesdale District, to the point national grid reference NS726 246; then in a north-westerly direction to the point national grid reference NS710 270; then, following the line of the western boundary of March Wood Plantation to the point of intersection with a disused railway line at the point national grid reference NS705 275; then in a south-westerly direction, following the line of the said disused railway line, to the point of intersection with an unnamed burn at the point national grid reference NS701 268; then in a south-easterly and south-westerly direction, following the line of the said burn to the point national grid reference NS704 260; then in a south-easterly direction to the summit of The Steel at spot height 413; then in a south-easterly direction to the point of intersection with the boundary between Cumnock and Doon Valley District and Clydesdale District; then in a southerly direction, following the line of said boundary, to the point of intersection with the boundary between the Parishes of Muirkirk and Auchinleck; then in a north-westerly direction, following the line of the boundary between said Parishes to the point national grid reference NS651 263..

2.  For paragraph 3(a) of Part II of Schedule 1 to the principal Order there shall be substituted the following—

(a)The area of land within Stirling District comprising that part of the Parish of Killin bounded as follows:—

  • On the north from the point national grid reference NN509 369 on the River Lochay in a south-easterly direction along the River Lochay to the point national grid reference NN570 342 and continuing generally in a southerly direction along the western boundary of the Monemore Plantation to the southernmost corner of said Plantation; then in a south-easterly direction to the River Dochart; then in a south-westerly direction, following the line of the said River Dochart, to the point of intersection with an unnamed burn at the point national grid reference NN508 287; then in a south-easterly direction following the line of said unnamed burn to the point of intersection with the Road A85; then in a north-easterly direction, following the line of said Road, to the point of intersection with the boundary between the Parishes of Killin and Balquhidder; then continuing in a westerly direction by said boundary to the point national grid reference NN470 250; then continuing in a north-westerly direction to the south-eastern corner of the Meall Thairbh Plantation; then continuing north following the Allt Coire Chaorach Burn until it meets the River Dochart; then in a westerly direction along the River Dochart to the point where it joins the Allt Riobain Burn; then northerly along said Burn to the summit of Meall a Churain; then in a north-easterly direction to the summit at spot height 881; then in an easterly direction to the summit at spot height 864; then in a south-easterly direction to the summit at spot height 766; then continuing generally in a northerly direction to and by the Allt Dubhchlair Burn until it meets the River Lochay at the point national grid reference NN509 369..

Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) Order 1991 which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been, or which may have been, rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the Ukraine.

This Order reduces the area subject to restriction.
