The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the common agricultural policy of the European Community, acting jointly in exercise of the powers conferred on them by that section and of all other powers enabling them in that behalf, hereby make the following Regulations:—
1. These Regulations may be cited as the Beef (Marketing Payment) (Amendment) Regulations 1996 and shall come into force on 1st November 1996.
2. Regulation 9 of the Beef (Marketing Payment) Regulations 1996(3), shall be replaced by—
“9. Except where the appropriate Minister recovers from any applicant a payment or part of a payment paid to that applicant as a result of an error of that Minister, he may charge interest on any payment recovered under regulation 8 at the rate of one percentage point above the sterling three months London Interbank Offered Rate on a day to day basis for the period from the date of payment to the date of reimbursement by the applicant.”.

These Regulations correct an error in regulation 9 of the Beef (Marketing Payment) Regulations 1996 so that the period for which the Minister may charge interest on a payment recovered pursuant to regulation 8 is specified.
