The Secretary of State for Health, in exercise of powers conferred by section 126(4) of the National Health Service Act 1977(1) and paragraphs 19(2)(b) and 20 of Schedule 2 to the Health Authorities Act 1995(2), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Health Authorities Act 1995 (Transitional Provisions) Amendment Order 1996 and shall come into force on 30th September 1996.

(2) In this Order—

“the 1985 Order” means the Joint Consultative Committees Order 1985(3);

“the 1996 Order” means the Health Authorities Act 1995 (Transitional Provisions) Order 1996(4).

Amendment of 1996 Order

2.  In article 12 of the 1996 Order (Joint Consultative Committees)—

(a) for the date “1st October 1996” there shall be substituted the date “1st January 1997”; and

(b) for the date “30th September 1996” which, by virtue of paragraphs (b) and (c)(i) of that article, has effect in articles 7 and 8 respectively of the 1985 Order, there shall be substituted the date “31st December 1996”.

Explanatory Note

(This note is not part of the Order)

This Order further amends the Health Authorities Act 1995 (Transitional Provisions) Order 1996 (“the 1996 Order”) which makes transitional provision in connection with the abolition, by the Health Authorities Act 1995 on 1st April 1996, of Regional Health Authorities, District Health Authorities and Family Health Services Authorities, and the establishment under that Act of Health Authorities to exercise functions, principally on behalf of the Secretary of State, in relation to the National Health Service.

This Order extends until 31st December 1996 the period during which certain persons who were members of Joint Consultative Committees (which are appointed under section 22 of the National Health Service Act 1977) on 31st March 1996 are to be given the opportunity to serve on such Committees, under the transitional arrangements made by the 1996 Order.
