Coming into force

The Secretary of State for Transport, in exercise of the powers conferred by section 11 of the Channel Tunnel Act 19871, hereby makes the following Order:–

This Order may be cited as the Channel Tunnel (International Arrangements) (Amendment) Order 1996 and shall come into force on 2nd October 1996.

The Channel Tunnel (International Arrangements) Order 19932 shall be amended as follows:

a

In the definition of “Frontier controls” in Schedule 1 (expressions defined) after the word “phytosanitary” there shall be inserted the words “, and transport and road traffic”;

b

In article 4 (application of enactments), in paragraph (1) after the words “frontier control enactments” there shall be inserted the words “except those relating to transport and road traffic controls” and after that paragraph there shall be inserted the following paragraph:–

All frontier control enactments relating to transport and road traffic controls shall for the purpose of enabling officers belonging to the United Kingdom to carry out such controls extend to France within the control zone in France within the tunnel system.

c

In article 7 (enactments modified) there shall be inserted at the end the following paragraph:–

The frontier control enactments relating to transport and road traffic controls in their application to France within the control zone in France within the tunnel system by virtue of article 4(1A) shall have effect as if any reference therein to a “public road” or “road” were a reference to any part of that control zone.

This Order amends the Channel Tunnel (International Arrangements) Order 1993 (“the Order”) so as to extend the provisions of primary and subordinate legislation relating to transport and road traffic frontier controls to the control zone in France within the tunnel system in the Channel Tunnel terminal at Frethun in France, in accordance with Articles 8,9 and 11 of the Protocol between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of the French Republic Concerning Frontier Controls and Policing, Co-operation in Criminal Justice, Public Safety and Mutual Assistance Relating to the Channel Fixed Link signed at Sangatte on 25 November 1991 (Cm 1802) which entered into force on 2 August 1993.

A new paragraph is inserted in article 7 (Enactments modified) so that any reference in those provisions of primary and subordinate legislation to a road or a public road is a reference to any part of the control zone.
