This Order provides for the commencement of certain provisions in the Education (Scotland) Act 1996 on 18th September 1996.
In Part I of the Act (which relates to the Scottish Qualifications Authority (SQA)) all provisions are commenced other than those conferring substantive functions on SQA.
SQA is to be established by order of the Secretary of State on 18th September 1996 but will not take up its substantive functions immediately. The property, rights, liabilities and obligations of the Scottish Examination Board and the Scottish Vocational Education Council will be transferred to SQA as their successor at a future date to be appointed by the Secretary of State, and the provisions conferring substantive functions will be commenced then.
Parts II (education for children under school age) and III (school boards) of the Act are commenced entirely on 18th September 1996. Part IV is also commenced on that date except for certain minor consequential amendments and repeal of section 129 of the Education (Scotland) Act 1980.
