170.—[F1(1) A person who is not receiving training falling within paragraph (2) [F2and is not a qualifying young person or child within the meaning of section 142 of the Benefits Act (child and qualifying young person)] may be entitled to an income-based jobseeker’s allowance without—
(a)being available for employment;
(b)having entered into a jobseeker’s agreement; or
(c)actively seeking employment,
if he is in receipt of a training allowance or if he would be in receipt of a training allowance if the Social Security (Breach of Community Order) Regulations 2001 did not prevent the payment of a training allowance to him.]
(2) Training falls within this paragraph if it is training for which persons aged under 18 are eligible and for which persons aged 18 to 24 may be eligible, [F3secured by the Learning and Skills Council for England or by the [F4Welsh Ministers] and, in Scotland, provided] directly or indirectly by a Local Enterprise Company[F5, or a Chamber of Commerce, Training and Enterprise, under its contractual arrangement with the Secretary of State].
