The Scottish Examination Board (Amendment No.2) Regulations 1996

The Secretary of State, in exercise of the powers conferred on him by section 129 of the Education (Scotland) Act 1980(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Scottish Examination Board (Amendment No.2) Regulations 1996 and shall come into force on 19th August 1996.

Amendment of the Scottish Examination Board Regulations 1981

2.  In regulation 13 of the Scottish Examination Board Regulations 1981(2)–

(a)in paragraph (5), there shall be inserted after the word “land” the words “or where the Secretary of State has given consent under paragraph (7)”; and

(b)after paragraph (6), there shall be inserted–

(7) The Board shall have power to enter into all types of borrowing transaction not authorised by paragraphs (5) and (6), provided that in each case the Secretary of State has first consented to the terms of the borrowing instrument..

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Scottish Examination Board Regulations 1981 to extend the borrowing powers of the Board. At present, except in relation to land purchase, the Board is only allowed to borrow on a six month overdraft. This amendment authorises other types of borrowing but only if the Secretary of State has first consented to the terms of the borrowing instrument.
