The Queen’s Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred on Her by section 2(2) of the European Communities Act 1972(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and Commencement

1.  This Order may be cited as the European Communities (Designation) (No. 2) Order 1996 and shall come into force on 23rd August 1996.

Designation of Ministers or departments

2.—(1) For the purposes of section 2(2) of the European Communities Act 1972 the Ministers or government departments specified in column (1) of the Schedule to this Order are hereby designated in relation to the matters specified in column (2) of that Schedule.

(2) Where a Minister or government department is designated in relation to any item in column (2) of the said Schedule, then, for the purposes of the said section 2(2), that Minister or government department is also hereby designated in relation to anything supplemental or related to the matters specified in that item.

(3) Regulations made by a Northern Ireland Department in pursuance of this Order shall form part of the law of Northern Ireland and not of any other part of the United Kingdom.

Revocation of earlier designation Order

3.  The European Communities (Designation) Order 1991(2) is hereby revoked.

SCHEDULEDESIGNATION

Ministers or departmentsMatters in relation to which the Ministers or departments are designated
The Secretary of StateMeasures relating to lifts and the safety components for use in lifts.
The Secretary of StateMeasures relating to the procedure for, nature of and enforcement of decisions concerning competition between undertakings.
Any Northern Ireland DepartmentMeasures in respect of the conditions of, and the recognition of qualifications for, access to and pursuit of activities in the field of pharmacy.

Explanatory Note

(This note is not part of the Order)

This is a further Order in the series designating Ministers who, and departments which, may exercise powers to make regulations conferred by section 2(2) of the European Communities Act 1972 and specifying the matters in relation to which those powers may be exercised. It revokes an earlier Order in the series (S.I. 1991/187).

S.I. 1991/187. The European Communities (Designation) Order 1991 designates the Secretary of State and any Northern Ireland Department in respect of the technical requirements relating to hydraulically and oil-electrically operated lifts and their components.
