Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Local Government Changes for England (Direct Labour and Service Organisations) Regulations 1994 which make provision for the application of the competition provisions of Part III of the Local Government, Planning and Land Act 1980 and Part I of the Local Government Act 1988 in relation to authorities (“relevant authorities”) affected by orders made under section 17 of the Local Government Act 1992. The relevant orders are those implementing recommendations made to the Secretary of State by the Local Government Commission for England pursuant to directions given to that Commission under section 13 of the Act of 1992.

Regulation 2(1) amends the definition of “relevant order” in the Regulations of 1994 by substituting 12th August 1996 for 17th May 1995 as the date before which directions should have been given for authorities to fall within the description of relevant authorities.

Regulation 2(2) makes transitional provision in respect of orders made before 12th August 1996 which implement recommendations made pursuant to directions given on or after 17th May 1995.
