The Contracting Out (Functions in relation to the Welfare Food Scheme) Order 1996

Whereas a draft of this Order has been laid before Parliament and approved by a resolution of each House of Parliament under section 77(2) of the Deregulation and Contracting Out Act 1994(1),

Now therefore the Secretary of State, in exercise of the powers conferred by section 69 of that Act, and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.—(1) This Order may be cited as the Contracting Out (Functions in relation to the Welfare Food Scheme) Order 1996.

(2) This Order shall come into force on the day after the day on which it is made.

Contracting out of certain functions in relation to the welfare food scheme

2.—(1) The functions of the Secretary of State specified in paragraph (2) which are conferred by any welfare food scheme made under section 13 of the Social Security Act 1988(2) may be exercised by, or by employees of, such person (if any) as may be authorised in that behalf by the Secretary of State.

(2) The functions referred to in paragraph (1) are—

(a)the function of reimbursement of suppliers of welfare food under the welfare food scheme; and

(b)the functions of requiring and receiving such information or evidence as may be reasonably needed in connection with the administration of any such scheme.

Explanatory Note

(This note is not part of the Order)

This Order makes provision to enable the Secretary of State to authorise another person, or that person’s employees, to exercise certain functions which are conferred on him by the welfare food scheme, namely the functions of reimbursing suppliers of welfare food and requiring and receiving information and evidence which may be reasonably needed in connection with the administration of the scheme.

1988 c. 7; section 13(4) was amended by the Social Security (Consequential Provisions) Act 1992 (c. 6), section 4, Schedule 2, paragraph 94. Subsections (7) and (8) were repealed by the Social Security Act 1990 (c. 27), section 21, Schedule 6, paragraph 8(11), Schedule 7. “Regulations made under Section 13 are the Welfare Food Regulations 1996 (S.I. 1996/1434)”.
