The Tameside (Ashton Northern By-Pass Stage 1 Ashton-Under-Lyne) (Special Roads) Scheme 1994 Confirmation Instrument 1996

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by Section 16 of the Highways Act 1980(1), and now vested in him(2), and of all other powers enabling him in that behalf:

1.  The Tameside (Ashton Northern By-Pass Stage 1 Ashton-under-Lyne) (Special Roads) Scheme 1994 is hereby confirmed with modifications.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme and its accompanying plan are deposited at the offices of the Department of Transport, 76 Marsham Street, London SW1 4DR and at the offices of Tameside Metropolitan Borough Council, Ashton Information Office, Council Offices, Wellington Road, Ashton-under-Lyne, Tameside OL6 6DL.

3.  The Scheme will come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the Tameside (Ashton Northern By-Pass Stage 1 Ashton-under-Lyne) (Special Roads) Scheme 1994 Confirmation Instrument 1996.

THE SCHEDULETHE TAMESIDE (ASHTON NORTHERN BY-PASS STAGE 1 ASHTON-UNDERLYNE) (SPECIAL ROADS) SCHEME 1994

Tameside Metropolitan Borough Council (herewith referred to as “the Council”) make this Scheme in exercise of their powers under Section 16 of the Highway Act 1980 and of all other powers enabling them in that behalf:

1.  The Council are authorised to provide special roads by constructing new highways along the routes specified in the Schedule to this Scheme as indicated by heavy black lines on the deposited plan.

2.  Special roads provided pursuant to this Scheme shall be used only by traffic of Class I or II as defined in Schedule 4 to the Highways Act 1980.

3.  In this Scheme “the deposited plan” means the plan marked “The Tameside (Ashton Northern By-Pass Stage 1, Ashton-under-Lyne) (Special Roads) Scheme 1994” sealed with the Common Seal of the Council and deposited at the offices of the Council at the Ashton Information Office, Council Offices, Wellington Road, Ashton-under-Lyne, Lancashire. A certified copy has been deposited at the Department of Transport, Sunley Tower, Piccadilly Plaza, Manchester, M1 4BE.

4.  This Scheme may be cited as the Tameside (Ashton Northern By-Pass Stage 1 Ashton-under-Lyne) (Special Roads) Scheme 1994.

THE SCHEDULE TO THE SCHEME

Three routes (respectively given the reference numbers 1, 2 and 3 on the deposited plan) comprising of slip roads to connect the northbound and southbound carriageways of the M66 Manchester Outer Ringroad Motorway with the Ashton Northern By-pass Stage 1 and southbound carriageway of the M66 Manchester Outer Ringroad Motorway with the A635 Manchester Road at Ashton-under-Lyne Tameside Greater Manchester.
