The Scottish Environment Protection Agency (Transfer Date) Order 1996

The Secretary of State, in exercise of the powers conferred on him by section 56(1) of the Environment Act 1995(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation

1.  This Order may be cited as the Scottish Environment Protection Agency (Transfer Date) Order 1996.

Transfer date

2.  For the purposes of Part I of the Environment Act 1995 as it applies for or in connection with transfers under or by virtue of Chapter II of that Part, the transfer date shall be 1st April 1996.

Explanatory Note

(This note is not part of the Order)

Chapter II of Part I of the Environment Act 1995 provides for the establishment of the Scottish Environment Protection Agency. That Chapter further provides for the transfer to that Agency on the transfer date of the functions, property, rights and liabilities of river purification authorities and Her Majesty’s Industrial Pollution Inspectorate and of certain functions, property, rights and liabilities of local authorities and the Secretary of State. This Order sets 1st April 1996 as the transfer date for those purposes.
