Whereas a draft of these Regulations was laid before Parliament in accordance with the provisions of sections 4, 6 and 7 of the Social Security (Incapacity for Work) Act 1994(1) and approved by resolution of each House of Parliament:

Now, therefore, the Secretary of State for Social Security, in exercise of the powers conferred by sections 4, 7 and 12 of the Social Security (Incapacity for Work) Act 1994, sections 171A, 171C, 171D and 171E of the Social Security Contributions and Benefits Act 1992(2), sections 59 and 61A of, and Schedule 3 to, the Social Security Administration Act 1992(3) and of all other powers enabling him in that behalf, by this instrument, which contains only regulations made by virtue of, or consequential upon, the Social Security (Incapacity for Work) Act 1994 and is made before the end of the period of 6 months beginning with the coming into force of that Act(4), hereby makes the following Regulations:

1992 c. 4; sections 171A and 171C were inserted by section 5 of the Social Security (Incapacity for Work) Act 1994 (c. 18) and sections 171D and 171E were inserted by section 6 of that Act.

1992 c. 5; section 61A was inserted by section 6(2) of the Social Security (Incapacity for Work) Act 1994 (c. 18).

See section 173(5)(b) of the Social Security Administration Act 1992 (c. 5), the effect of which is that regulations which are made by virtue of or consequential on a specified enactment and within 6 months after the coming into force of that enactment are not required to be referred to the Social Security Advisory Committee.
