Explanatory Note

(This note is not part of the Regulations

1.  These Regulations re-enact with modifications the provisions of The Motor Vehicles (Type Approval and Approval Marks) (Fees) Regulations 1994.

2.  The Regulations prescribe the fees payable for the examination of vehicles and vehicle parts, the examination of complete vehicles and the issue of documents in connection with—

(a)the type approval of vehicles and vehicle parts and the authorisation of the application of approval marks to vehicle and vehicle parts for the purposes of Community Instruments and ECE Regulations; and

(b)the national scheme for the type approval of vehicles and vehicle parts established under sections 54 to 66 of the Road Traffic Act 1988, the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984 (S.I. 1984/981) and the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982 (S.I. 1982/1271).

3.  In addition the Regulations prescribe the fees payable for—

(a)the examination of premises with a view to their being approved for the purposes of carrying out examinations in accordance with a type approval scheme, a community Instrument or an ECE Regulation; and

(b)advising a manufacturer whether his arrangements for securing conformity of production are likely to be accepted by the Secretary of State.

4.  The Regulations make the following changes of substance.

5.  The principal changes relate to the fee amounts; these changes result in an overall increase of 1%. There is also a modification of the basis on which fees are charged for a prescribed notification of differences of design, construction, equipment or marking (regulation 16) when the vehicle is in category N1 (a goods vehicle with a gross vehicle weight not exceeding 3500kg). A fee of £30 is now payable on an annual basis whether or not there was more than one notification during that year.

6.  The introduction of new or amended ECE Regulations and new Community Instruments means that—

(a)certain new fees relating to tests for light goods vehicles and tests for lighting installation, statutory plates, space for fitting rear registration plates, passenger hand holds, horns and stands for motorcycles have been added to Schedule 1; and

(b)new standards appear for protective steering for passenger cars and light goods vehicles and mechanical coupling devices for vehicles with four or more wheels.

7.  Copies of the ECE Regulations and Community Instruments referred to in these Regulations may be obtained from Her Majesty’s Stationery Office.
