In exercise of the powers conferred by sections 218(1)(a), (2), (2A), (2B) and (3) and 232(5) and (6) of the Education Reform Act 1988(1) and paragraph 3 of Schedule 18 to the Education Act 1993(2), the Secretary of State hereby makes the following Regulations:

1988 c. 40. Section 218(2A) was inserted by section 14(1) of the Education Act 1994 (c. 30). Seesection 114(1) of the Education Act 1944 (c. 31) for the definition of “prescribed”. Section 218 (2B) was inserted as section 218(2A) by section 291 of the Education Act 1993 (c. 35) and amended and re–numbered (2B) by paragraph 8(4) of Schedule 2 to the Education Act 1994. Sections 218(3) and 232(6) were amended by sections 14(3) and (4) respectively of the Education Act 1994.
