The Roads (Transitional Powers) (Scotland) Amendment Order 1995

The Secretary of State, in exercise of the powers conferred on him by sections 12A, 12B and 143(1) of the Roads (Scotland) Act 1984(1) and of all other powers enabling him in that behalf, having considered it necessary or expedient as a result of, or in connection with, the establishment of new local government areas on 1st April 1996, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Roads (Transitional Powers) (Scotland) Amendment Order 1995 and shall come into force on 31st January 1996.

Amendment

2.—(1) The Roads (Transitional Powers) (Scotland) Order 1995(2) shall be amended in accordance with the following paragraphs.

(2) For article 4(1) and (2) there shall be substituted—

(1) It is directed that as from the specified date the proposed roads listed in Schedule 2 to this Order shall become trunk roads..

(3) In Part I of Schedule 1 paragraph 15 shall be omitted and in Part II of that Schedule paragraphs 6 and 7 shall be omitted together with the corresponding entries in relation to the local roads authority.

(4) In Schedule 2 there shall be omitted Part II and the words “Part I”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Roads (Transitional Powers) (Scotland) Order 1995. That Order provided for a change in the status of certain roads consequential upon the establishment of new local government areas on 1st April 1996.

The amendments made by this Order will mean that—

(i)the A819 road mentioned in paragraph 15 of Part I of Schedule 1 to the original order will not become a trunk road; and

(ii)the A828 trunk road mentioned in paragraphs 6 and 7 of Part II of Schedule 1 will remain a trunk road and the proposed road mentioned in Part II of Schedule 2 to the original order will become part of the A828 trunk road on completion.
