CUSTOMS AND EXCISE

The Police and Criminal Evidence Act 1984 (Application to Customs and Excise) (Amendment ) Order 1995

The Treasury, in exercise of the powers conferred on them by section 114(2) of the Police and Criminal Evidence Act 1984(1), hereby make the following Order:

1.  This Order may be cited as the Police and Criminal Evidence Act 1984 (Application to Customs and Excise) (Amendment) Order 1995 and shall come into force on 1st January 1996.

2.  The Police and Criminal Evidence Act 1984 (Application to Customs and Excise) Order 1985(2) shall be amended as follows:

(a)In article 3(1) for the words “articles 4 to 11” there shall be substituted the words “articles 4 to 12”.

(b)In Schedule 1 after the words “Section 22(1) to (4)” there shall be inserted the words “Section 24(6), subject to the modification in article 12 hereof”.

(c)After article 11 there shall be added the following article:

—12.  Section 24(6) of the Act shall apply without prejudice to section 138(1) of the Customs and Excise Management Act 1979(3), section 72(9) of the Value Added Tax Act 1994(4), section 20 of and paragraph 4 of Schedule 3 to the Criminal Justice (International Co-operation) Act 1990(5), or any other enactment, including any enactment contained in subordinate legislation, for the time being in force which confers upon officers of Customs and Excise the power to arrest or detain persons.

Explanatory Note

(This note is not part of the Order)

This Order applies section 24(6) of the Police and Criminal Evidence Act 1984 to Customs and Excise. It gives to officers of Customs and Excise a power of arrest in respect of arrestable offences, the investigation of which is a matter assigned to the Commissioners of Customs and Excise and for which such officers do not otherwise have a power of arrest.
