Explanatory Note

These Regulations amend the Local Government Act 1988 (Defined Activities) (Competition) (Supervision of Parking, Management of Vehicles and Security Work) (England) Regulations 1994. The effect is to alter the date from which the compulsory competitive tendering requirements of the Local Government Act 1988 in respect of the supervision of parking apply to county councils and non-metropolitan district councils which are not subject to a structural change pursuant to local government reorganisation. The alteration substitutes for 1st October 1997, in relation to such county councils, a date of 1st April 1997 and, in relation to such non-metropolitan district councils, substitutes for 1st January 1996 a date of 1st April 1997. The amendment made replaces that made in relation to the supervision of parking by the Local Government Act 1988 (Defined Activities) (Competition) (Amendment) Regulations 1995 and, in consequence, revokes regulation 4(a) of those Regulations. Regulation 4(b) of those Regulations is substituted, in order to correct a minor error in that instrument.
