These Regulations amend the Motorways Traffic (Scotland) Regulations 1995 (“the 1995 Regulations”) which regulate the use of motorways.
Regulation 11 of the 1995 Regulations prohibits certain classes of vehicle from using the right-hand lane of motorways where a carriageway has three or more lanes. Regulation 11(1)(b) is substituted so that passenger vehicles, which are constructed or adapted to carry eight or more seated persons in addition to the driver and that have a maximum laden weight that exceeds 7.5 tonnes, shall be prohibited vehicles for the purpose of that regulation.
The effect of this amendment is that it widens the range of passenger carrying vehicles prohibited from using the right hand lane of a motorway, when there are three or more lanes.
