The Pensions Act 1995 (Commencement No. 1) Order 1995

The Secretary of State for Social Security, in exercise of the powers conferred on him by section 180(1) of the Pensions Act 1995(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.  This Order may be cited as the Pensions Act 1995 (Commencement No. 1) Order 1995.

Appointed day

2.  The day appointed for the coming into force of the following provisions of the Pensions Act 1995 is 2nd October 1995—

  • section 90 (unpaid contributions in cases of insolvency);

  • section 156 (employment of staff by the Pensions Ombudsman);

  • section 169 (extensions of Pensions Appeal Tribunals Act 1943)(2);

  • section 172, and sections 174 and 175 in so far as they relate to that section, (information about public service schemes);

  • paragraph 1 of Schedule 6, and section 173 in so far as it relates to that paragraph, (amendment to the Public Records Act 1958)(3).

Explanatory Note

(This note is not part of the Order)

This Order brings into force the following provisions of the Pensions Act 1995 on 2nd October 1995—

  • section 90, which amends provisions in the Pension Schemes Act 1993 concerning unpaid contributions in cases of insolvency;

  • section 156, which amends provisions in the Pension Schemes Act 1993 concerning the employment of staff by the Pensions Ombudsman;

  • section 169, which amends the Pensions Appeal Tribunals Act 1943 in relation to appeal rights for war pensioners;

  • section 172, which provides for the disclosure of information by public service pension schemes in certain circumstances;

  • paragraph 1 of Schedule 6, which provides for the insertion of a reference to the Pensions Ombudsman in the Public Records Act 1958.
