The Secretary of State, in exercise of powers conferred on him by section 94(1), (5) and (6) of the Police and Magistrates' Courts Act 1994(1), hereby makes the following Order:
1.—(1) This Order may be cited as the Police and Magistrates' Courts Act 1994 (Commencement No. 5 and Transitional Provisions) (Amendment) Order 1995.
(2) This Order shall come into force on 14th March 1995.
2.—(1) The Police and Magistrates' Courts Act 1994 (Commencement No. 5 and Transitional Provisions) Order 1994(2) shall be amended in accordance with paragraphs (2) and (3) below.
(2) In article 4(2) (which provides that the commencement of section 4C of the Police Act 1964(3) shall not apply in respect of the financial year ending on 31st March 1994) for the words “March 1994” there shall be substituted the words “March 1995”.
(3) In article 11(4) (which provides for the calculation of an increase in loan debt in specified financial years by reference to the issue of certain supplementary credit approvals)—
(a)before the word “issued” there shall be inserted “used by the council and”;
(b)in sub-paragraph (a), for the words “the council” there shall be substituted “a local authority”;
(c)after the words “ceiling of the” there shall be inserted “relevant”, and
(d)for the words “such functions” there shall be substituted “its police authority functions”.

This Order amends two transitional provisions in the Police and Magistrates' Courts Act 1994 (Commencement No. 5 and Transitional Provisions) Order 1994 ( “the 1994 Order”).
Under section 4C of the Police Act 1964, as inserted by section 4 of the Police and Magistrates' Courts Act 1994, the new police authorities established by virtue of the 1994 Act must, as soon as possible after the end of each financial year, issue a report relating to the policing of their areas for that year. Article 4(2) of the 1994 Order disapplied this provision as respects the financial year ending on 31st March 1994. Article 2(2) of this Order corrects that reference so that it refers to the financial year ending on 31st March 1995.
