The Secretary of State for Transport, in exercise of the powers conferred by sections 54(1) and 61 of the Road Traffic Act 1988(1), and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) (Amendment) Regulations 1995 and shall come into force on 12th June 1995.

Preliminary

2.  The Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982(2) shall be further amended in accordance with the following provisions of these Regulations.

Amendments to regulation 4 (application of type approval requirements)

3.—(1) Regulation 4 shall be amended as follows.

(2) In paragraph (2A), for the words “exhaust emissions from any vehicle,” onwards there shall be substituted the words “exhaust emissions from any vehicle (other than a vehicle with fewer than 4 wheels or fuelled solely by liquid petroleum gas), or to noise emissions from any vehicle.”.

(3) In paragraph (4A), for “2D and 2F” there shall be substituted “2D, 2F, 2I, 4D(4) and 4E”.

(4) In paragraph (14), after “2F,” there shall be inserted “2I, 4D(4), 4E,”.

Amendments to regulation 14 (forms of certificate)

4.—(1) Regulation 14 shall be amended as follows.

(2) In paragraph (2), for “IV” there shall be substituted “V”.

(3) In paragraph (3), for “Part I or II,” there shall be substituted “Parts I, II or III,”.

Amendments to Part I of Schedule 1

5.—(1) Part I of Schedule 1 shall be amended as follows.

(2) In item 2I, in column 6, there shall be inserted “See regulation 4(14) and Schedule 1B”.

(3) After item 2I there shall be inserted the item set out in Schedule 1 to these Regulations.

(4) In items 4D(4) and 4E, in column 6, there shall be inserted “See regulation 4(14) and Schedule 1B”, opposite “1.10.1987” and “1.10.1993” in column 5.

Amendments to Schedule 1B (date of application and cessation of certain type approval requirements)

6.—(1) Part I of Schedule 1B shall be amended as follows.

(2) In paragraph 1A, after “2F,”, there shall be inserted “2I, 4D(4), 4E,”.

7.  In Part II of Schedule 1B, after the entry relating to item 2F in Part I of Schedule 1, there shall be inserted the following entries:—

Amendments to Schedule 2 (form of information document for a goods vehicle)

8.  For Part I of Schedule 2, there shall be substituted the Part set out in Schedule 2 to these Regulations.

Amendments to Schedule 4 (forms of certificate)

9.—(1) Part III of Schedule 4 shall be amended as follows.

(2) For the heading there shall be substituted the following heading—

(Form of Minister’s approval certificate for a goods vehicle, with a maximum gross weight not exceeding 3500 kg, of a type covered by a previous certificate).

10.  In Schedule 4, after Part IV, there shall be added the Part set out in Schedule 3 to these Regulations.

Amendments to Schedule 5 (forms of certificate)

11.—(1) Part I of Schedule 5 shall be amended as follows.

(2) For the heading there shall be substituted the following heading—

(Form of certificate of conformity for a goods vehicle with a maximum gross weight not exceeding 3500 kg).

12.  In Schedule 5, after Part II, there shall be added the Part set out in Schedule 4 to these Regulations.

1.  Vehicles of category N2 with a reference mass (which expression shall for the purposes of this item shall have the same meaning as in Council Directive 91/441/EEC) exceeding 2,840 kg propelled by compression ignition engines.

2.  Vehicles with less than four wheels.

3.  Vehicles fuelled by liquid petroleum gas.

Explanatory Note

(This note is not part of the Regulations)

These Regulations further amend the Motor Vehicles (Type Approval for Goods Vehicles) (Great Britain) Regulations 1982.

Regulation 4 of the 1982 Regulations is amended so that as from 12th June 1995, the type approval requirements relating to noise emissions then in force shall apply to a vehicle regardless of the date of manufacture.

The type approval requirements relating to exhaust emissions are revised so as to—

(a)introduce the requirements of Directive 94/12/EC as a new alternative; and

(b)provide for the standard to become mandatory by removing the option of complying with Council Directive 93/59/EEC, from 1st January 1996 for new vehicle types and from 1st January 1997 for existing types.

The type approval requirements relating to noise are revised so as to provide for the requirements of Council Directive 92/97/EEC to become mandatory by removing the option of complying with Council Directive 84/424/EEC or ECE Regulation 51 as amended, from 1st October 1995 for new vehicle types and from 1st October 1996 for existing types.

As a result of a change in the maximum permissible weight of goods vehicles involved in combined transport operations—

(a)the form of the appropriate information document for a goods vehicle, which must accompany an application for both type approval and a Minister’s approval certificate, is revised;

(b)the use of the existing form of Minister’s approval certificate for a goods vehicle of a type covered by a previous certificate (“sub-MAC”) is limited to goods vehicles with a maximum gross weight not exceeding 3500 kg;

(c)a new form of sub-MAC is introduced for use both as an alternative in the case of goods vehicles with a maximum gross weight not exceeding 3500 kg and in all cases of goods vehicles with a maximum gross weight exceeding 3500 kg;

(d)the use of the existing form of certificate of conformity for a goods vehicle is limited to goods vehicles with a maximum gross weight not exceeding 3500 kg; and

(e)a new form of certificate of conformity is introduced for use both as an alternative in the case of goods vehicles with a maximum gross weight not exceeding 3500 kg and in all cases of goods vehicles with a maximum gross weight exceeding 3500 kg.
