The Secretary of State, in exercise of the powers conferred on him by paragraph 11(5) of Schedule 11 to the Railways Act 1993(1)) and of all other powers enabling him in that behalf, hereby makes the following Order:

1.  This Order may be cited as the Railways Pensions Guarantee (Prescribed Persons) Order 1994 and shall come into force on 18th August 1994.

2.  For the purpose of determining whether the 1994 Pensioners “A” Section of the Railway Pensions Scheme(2) satisfies the conditions in paragraph 11(3) of Schedule 11 to the Railways Act 1993 there shall be disregarded the membership of that section of—

(a)any persons the liabilities in respect of whose pension rights are transferred to the 1994 Pensioners “A” Section pursuant to rule 17 of the rules of the 1994 Pensioners “B” Section; and

(b)any persons admitted to membership of the 1994 Pensioners “A” Section pursuant to the second paragraph of rule 2 of the rules of that section.

Explanatory Note

(This note is not part of the Order)

This Order prescribes classes of persons whose membership of the 1994 Pensioners “A” Section of the Railways Pension Scheme is to be disregarded for the purpose of determining whether that section satisfies the conditions in paragraph 11(3) of Schedule 11 to the Railways Act 1993. The following classes of persons are prescribed:—

(a)persons whose pension rights are transferred from the 1994 Pensioners “B” Section under rule 17 of the rules of the 1994 Pensioners “B” Section;

(b)persons who are admitted under the second paragraph of rule 2 of the rules of the 1994 Pensioners “A” Section.
