Citation, commencement, interpretation and extent

1.—(1) These Regulations may be cited as the Notification of Existing Substances (Enforcement) Regulations 1994 and shall come into force on 29th July 1994.

(2) In these Regulations—

  • “the chief inspector” means, in relation to England and Wales, the chief inspector for England and Wales constituted under section 16(3) of the 1990 Act and, in relation to Scotland, the chief inspector for Scotland so constituted;

  • “the Council Regulation” means Council Regulation (EEC) No. 793/93 on the evaluation and control of the risks of existing substances(1);

  • “the Executive” means the Health and Safety Executive;

  • “existing substances” has the meaning given to it by Article 2(e) of the Council Regulation;

  • “health and safety inspector” means an inspector appointed by the Executive under section 19 of the 1974 Act;

  • “inspector” means an inspector appointed by the Secretary of State under section 16(1) of the 1990 Act;

  • “the 1974 Act” means the Health and Safety at Work etc. Act 1974(2);

  • “the 1990 Act” means the Environmental Protection Act 1990(3).

(3) These Regulations shall not extend to Northern Ireland.
