The Export of Goods (Control) Order 1994 (Amendment) Order 1994

The Secretary of State, in exercise of powers conferred by section 1 of the Import, Export and Customs Powers (Defence) Act 1939(1) and now vested in him(2), and of all other powers enabling him in that behalf, hereby makes the following Order:

1.  This Order may be cited as the Export of Goods (Control) Order 1994 (Amendment) Order 1994 and shall come into force on 18th June 1994.

2.  The Export of Goods (Control) Order 1994(3) shall be amended as follows:—

(a)in article 3(e)(ii)(bb) the words “other than a destination in South Africa” shall be deleted;

(b)in Group 1 of Part III of Schedule 1—

(i)in entry ML9, for the words “and specially designed components therefor” there shall be substituted the words “and components therefor specially designed or modified for military use”;

(ii)in entry PL5001 sub-head b. the words “anti-riot helmets” shall be deleted;

(c)in Group 3 of Part III of Schedule 1—

(i)in the Note to the definition of composite theoretical performance, for the first two sections of the table there shall be substituted the following:

(ii)in entry 5D002, for the words “that equipment 5A002” there shall be substituted the words “that equipment”;

(iii)in entry 6A003 the Note following sub-head b.4. shall be deleted;

(iv)in entry 8A002 the Note preceding sub-head a. shall be deleted;

(v)in entry 9A990, for “Libya, Iran, Iraq, Syria or South Africa.” there shall be substituted “Libya, Iran, Iraq or Syria.”; and

(vi)in entry 9E990, for “Libya, Iran, Iraq, Syria or South Africa.” there shall be substituted “Libya, Iran, Iraq or Syria.”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Export of Goods (Control) Order 1994:

(i)by removing from control anti-riot helmets;

(ii)by removing from control civil aircraft and components, and technology therefor, destined for South Africa;

(iii)by relaxing control on personal firearms destined for South Africa; and

(iv)by correcting minor errors in the table in the definition of composite theoretical performance in relation to computers, and in entries 5D002, 6A003 and 8A002 in Part III of Schedule 1.
