The Road Traffic (Special Parking Areas) (London Borough of Richmond upon Thames) (Amendment) Order 1994

Whereas the council of the London borough of Richmond upon Thames has applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1) amending an order made by him under that section, and the Secretary of State has consulted the Commissioner of Police of the Metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Areas) (London Borough of Richmond upon Thames) (Amendment) Order 1994 and shall come into force on 17th June 1994.

Interpretation

2.  In this Order, unless the context otherwise requires,“the principal Order” means the Road Traffic (Special Parking Areas) (London Boroughs of Richmond upon Thames and Southwark) Order 1993(2); and

• “the 1984 Act” and “the 1991 Act” have the same meanings as in the principal Order.

Amendment of the principal Order.

3.—(1) The principal Order shall have effect as if the areas referred to in the Schedule to this Order were included in the special parking area designated by article 3(1)(a) of the principal Order.

(2) In article 3(1)(a) of the principal Order after “Schedule 1” there shall be inserted “and the areas described in Schedule 1A”.

(3) The following Schedule shall be inserted after Schedule 1 to the principal Order:—

“SCHEDULE 1A AREAS IN THE LONDON BOROUGH OF RICHMOND UPON THAMES EXCLUDED FROM THE SPECIAL PARKING AREA

1.   Bushy Park

2.   Hampton Court Park

3.   So much of Richmond Park as lies within the London borough of Richmond upon Thames.”

(4) Article 4 (modification of the 1984 Act) and article 5 (modification of the 1991 Act) of the principal Order shall apply in relation to the areas referred to in the Schedule to this Order as they apply to the special parking areas designated by article 3 of that Order, so that references in article 4 or 5 to a special parking area shall be taken to include an area referred to in the Schedule to this Order.

Article 3(1)(a)

SCHEDULE AREAS IN THE LONDON BOROUGH OF RICHMOND UPON THAMES INCLUDED IN THE SPECIAL PARKING AREA

1.  The areas transferred from the county of Surrey and the district of Spelthorne to the London borough of Richmond upon Thames and referred to in article 3 of the Greater London and Surrey (County and London Borough Boundaries) (No.2) Order 1993(3).

2.  The areas transferred from the London borough of Wandsworth to the London borough of Richmond upon Thames and referred to in article 14 of the Greater London and Surrey (County and London Borough Boundaries) (No.2) Order 1993.

3.  The areas transferred from the London borough of Hounslow to the London borough of Richmond upon Thames and referred to in the table to article 5(1) of the Greater London and Surrey (County and London Borough Boundaries) (No.4) Order 1993(4).

4.  The areas transferred from the county of Surrey and the district of Spelthorne to the London borough of Richmond upon Thames and referred to in article 4 of the Greater London and Surrey (County and London Borough Boundaries) (No.4) Order 1993.

Explanatory Note

(This note is not part of the Order)

The Road Traffic (Special Parking Areas) (London Boroughs of Richmond upon Thames and Southwark) Order 1993 (“the principal Order”) designated the whole of the London boroughs of Richmond upon Thames and Southwark (excluding certain specified roads) as special parking areas for the purposes of Part II of the Road Traffic Act 1991. It also made consequential modifications to the Road Traffic Regulation Act 1984 and to Part II of the 1991 Act. This Order amends the principal Order by adding to the special parking area in the London borough of Richmond upon Thames designated by it the areas referred to in the Schedule, which are areas which were transferred to the London borough of Richmond upon Thames in pursuance of local government boundary changes, and by excluding the Royal Parks in the borough from the special parking area. The consequential modifications in the principal Order of the 1984 and 1991 Acts are applied to the areas added to the special parking area.
