The Education (National Curriculum) (Exceptions in Welsh at Key Stage 4) Regulations 1994

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Education (National Curriculum) (Exceptions in Welsh at Key Stage 4) Regulations 1994 and shall come into force on 1st August 1994.

(2) In these Regulations—

“the Act” means the Education Reform Act 1988;

a reference to the provisions of the National Curriculum in Welsh and Welsh Second Language is to such attainment targets, programmes of study and assessment arrangements as are specified for the time being for the foundation (or core) subject Welsh in relation to the fourth key stage by orders made under section 4(2) of the Act(1);

a reference to a Welsh-speaking school is to such a school as defined by section 3(7) of the Act; and

a reference to the fourth key stage is to the period set out in paragraph (d) of section 3(3) of the Act.

Exceptions to the provisions of the National Curriculum

2.—(1) In respect of the period beginning with the date of the coming into force of this Order and ending on the relevant date, the provisions of the National Curriculum in Welsh (including Welsh Second Language) shall not apply in the case of a pupil in the fourth key stage at a school which is not a Welsh-speaking school.

(2) In paragraph (1) above, “the relevant date” means, in the case of pupils entering the first year of the fourth key stage, 31st July 1999, and in the case of pupils entering the second year of that key stage, 31st July 2000.

Transitional provision

3.  These Regulations do not apply in relation to pupils who commenced the first year of the fourth key stage in 1993.
