CHANGES IN LOCAL GOVERNMENT AREAS

The Greater Manchester and Lancashire (County and District Boundaries) Order 1993

The Secretary of State, in exercise of his powers under sections 51(2) and 67(4) of the Local Government Act 1972(1) and of all other powers enabling him in that behalf, hereby makes the following Order which gives effect to proposals submitted to him under sections 47, 48(1) and 51(1) of that Act, more than six weeks before the making of this Order, by the Local Government Boundary Commission for England:

Citation and commencement

1.—(1) This Order may be cited as the Greater Manchester and Lancashire (County and District Boundaries) Order 1993.

(2) This Order shall come into force on 1st December 1993 for any purpose set out in regulation 4(1) of the Local Government Area Changes Regulations 1976(2).

(3) For all other purposes, this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order—

Transfer from Lancashire (Blackburn) to Greater Manchester (Bury)

3.  The area which is marked B16 on map 7 shall become unparished and shall be transferred from Lancashire, from Blackburn, and from the parish of North Turton to—

(a)Greater Manchester;

(b)Bury;

(c)the Tottington ward; and to

(d)the Bury petty sessional division, and the Greater Manchester North coroner’s district.

Transfer from Greater Manchester (Bury) to Lancashire (Rossendale)

4.  The area which is marked B15 on map 6 shall be transferred from Greater Manchester, from Bury, and from the Ramsbottom ward to—

(a)Lancashire;

(b)Rossendale;

(c)the Eden ward and the Rossendale West electoral division; and to

(d)the Rossendale petty sessional division, and the East Lancashire coroner’s districtremaining unparished.

Transfers within Greater Manchester from Bury to Manchester

5.  The following areas of Bury

(i)the part of the Holyrood ward marked B14 on map 5; and

(ii)the parts of the Sedgley ward marked B6, B8 and B10 on map 3shall be transferred to Manchester, to the Crumpsall ward, to the Manchester petty sessional division, and to the Manchester coroner’s district, remaining unparished.

Transfers within Greater Manchester from Manchester to Bury

6.—(1) The areas marked B12 and B13 on map 4 shall be transferred from Manchester, and from the Crumpsall ward to Bury, and to the Holyrood ward.

(2) The areas which are marked B7, B9 and B11 on map 3 shall be transferred from Manchester, and from the Crumpsall ward to Bury and to the Sedgley ward.

(3) All areas transferred by this article shall additionally be transferred to the Bury petty sessional division and the Greater Manchester North coroner’s district, and shall remain unparished.

Transfers within Greater Manchester from Bury to Salford

7.  The following areas of Bury

(i)the parts of the Sedgley ward marked B4 and B5 on map 3; and

(ii)the part of the St Mary’s ward marked B1 on map 1-shall be transferred to Salford, to the Kersal ward, to the Salford petty sessional division, and to the Greater Manchester West coroner’s district, remaining unparished.

Transfers within Greater Manchester from Salford to Bury

8.  The areas which are marked B2 on map 1 and B3 on map 2 shall be transferred from Salford, and from the Kersal ward to Bury, to the St Mary’s ward, to the Bury petty sessional division, and to the Greater Manchester North coroner’s district, remaining unparished.

Town and country planning

9.—(1) In this article, “provision” means a provision of a development plan (as defined in section 336(1) of the Town and Country Planning Act 1990(5)).

(2) Any provision applying to an area transferred by this Order shall continue to apply to that area, notwithstanding the transfer, until replaced by a provision which so applies, and which is expressed to supersede the preserved provision.

Explanatory Note

(This note is not part of the Order)

This Order makes two small changes to the boundary between Lancashire and GreaterManchester.

One area is transferred from Lancashire (borough of Blackburn) to themetropolitan borough of Bury in Greater Manchester, and the other is transferred fromBury to Lancashire (Rossendale).

Changes, mainly of a minor nature, are also made to thedistrict boundaries within Greater Manchester.

These involve the boundary of Bury withManchester, and with Salford.

Consequential changes are made to the boundaries of local government electoral areas,petty sessional divisions and coroner’s districts.

The map and table forming part of this Note (Pages 4 and 5) give a general guide to thelocation, area and population of the land affected.

Prints of the detailed order maps(described in article 2) may be inspected at all reasonable times at the offices of the councilfor each borough or city affected, and additionally at the offices of the Secretary of Statefor the Environment located in 2, Marsham Street, London SW1P 3EB.

The Local Government Area Changes Regulations 1976 (S. I. 1976/246, amended by S. I.1978/247) contain general provisions regarding the effect of orders such as this one.

Transfer of area located south-west of the M66 motorway at Heaton Park, and running south-eastwards from Bridle Road to the River Irk, including part of Old Hall Lane and properties in that Lane near its junction with Middleton Road.

Realignments in the following vicinities

(i)

site of former Jubilee School in Park Road;

(ii)

Brooklands Road/Carlton Avenue/Huntley Road;

(iii)

Edenfield Road/Windsor Crescent.

Manchester to Bury— article 6 Area: 6 Population: 400

At Heaton Park, transfer of St Margaret’s Lodge in St Margaret’s Road, and of School Lodge in Bury Old Road.

Transfer of largely residential area on the western side of Middleton Road, including the United Synagogue, Newington Avenue, Hillwood Avenue, Windsor Crescent and part of Meade Hill Road.

Realignments

(i)

to the rear of properties on the eastern side of Edenfield Road; and

(ii)

between Park Road and Rothesay Road.

Bury to Salford— article 7 Area: 1 Population: 16

Realignments

(i)

in vicinity of Kersal Vale Road, so that boundary follows the line of Singleton Brook to its junction with the River Irwell; and

(ii)

in Bury Old Road/Singleton Road.

Salford to Bury— article 8 Area: 2 Population: 0

Realignment at Moor Lane to unite Kersal Vale Works in Bury.

Realignment to unite Mountheath Industrial Park in Bury.
