MAINTENANCE OF DEPENDANTS

This Order provides for the implementation in the United Kingdom of the Convention on the Recognition and Enforcement of Decisions Relating to Maintenance Obligations concluded at The Hague on 2nd October 1973. It replaces and revokes an earlier order (the Reciprocal Enforcement of Maintenance Orders (Hague Convention Countries) Order 1979 to similar effect. The differences between this Order and the 1979 Order reflect changes made in the domestic law in England and Wales, and Northern Ireland on maintenance since then, including the Children Act 1989 (c. 41), the Maintenance Enforcement Act 1991 (c. 17) and the Maintenance Orders (Reciprocal Enforcement) Act 1992 (c. 56).

SCHEDULE 2MODIFICATIONS TO PART I OF THE ACT

Section 14 shall be amended as follows.

In subsection (1)–

a

for the word “reciprocating” there shall be substituted the words “Hague Convention”;

b

for the words from “in the prescribed manner” to the end there shall be substituted the following words–

by the prescribed officer of the court–
a
in England and Wales or Northern Ireland, to the Lord Chancellor, or
b
in Scotland, to the Secretary of State,
for transmission to the appropriate authority in the Hague Convention country

In subsection (2), for paragraphs (a) and (b) there shall be substituted the words “out of moneys provided by Parliament”.

In subsections (3) and (4) respectively, for the word “reciprocating” there shall be substituted the words “Hague Convention”.

For subsection (5) there shall be substituted–

A court in–
a
England and Wales or Northern Ireland may for the purpose of any proceedings in that court under this Part of this Act relating to a maintenance order to which this Part of this Act applies send to the Lord Chancellor, or
b
Scotland may for the purpose of such proceedings in that court relating to such an action, send to the Secretary of State,
for transmission to the appropriate authority in a Hague Convention country a request for a court in a Hague Convention country to take or provide evidence relating to such matters as may be specified in the request.
