PROBATION

The Probation (Amendment) Rules 1993

In exercise of the powers conferred upon me by paragraph 18(1)(a) of Schedule 3 to the Powers of Criminal Courts Act 1973(1), I hereby make the following Rules:

1.  These Rules may be cited as the Probation (Amendment) Rules 1993 and shall come into force on 1st April 1993.

2.  For rule 9 of the Probation Rules 1984(2) there shall be substituted the following rule—

9.(1) A probation committee shall appoint annually from among its members a chairman and may so appoint a deputy chairman.

(2) A probation liaison committee shall appoint annually from among its members, other than co-opted members, a chairman and may so appoint a deputy chairman.

(3) A committee referred to in paragraph 1 or 2 of this rule shall fill a vacancy in the office of chairman whenever it occurs..

3.  For rule 11 of the Probation Rules 1984(3) there shall be substituted the following rule—

11.  A probation committee shall appoint such person as it thinks fit as its treasurer..

Explanatory Note

(This note is not part of the Rules)

These Rules amend the Probation Rules 1984 by substituting a new rule 9 (rule 2 of these Rules) and rule 11 (rule 3 of these Rules). The change in rule 9 broadens the eligibility of members of a probation committee to be the chairman or deputy chairman of the committee to include co-opted members. Under new rule 11 a probation committee is to appoint such person as it thinks fit to be its treasurer.
