The Broadcasting (Restrictions on the Holding of Licences) (Amendment) Order 1993

The Secretary of State, in exercise of the powers conferred on him by paragraph 2(3)(b) and (4) of Part III of Schedule 2 to the Broadcasting Act 1990(1) and of all other enabling powers, hereby makes the following Order a draft of which has been laid before and approved by a resolution of each House of Parliament:—

1.  This Order may be cited as the Broadcasting (Restrictions on the Holding of Licences) (Amendment) Order 1993 and shall come into force on 1st January 1994.

2.  The Broadcasting (Restrictions on the Holding of Licences) Order 1991(2) shall be amended as follows:—

(1) for article 3 there shall be substituted the following article:—

3.(1) In addition to the limits on the holding of licences to provide regional Channel 3 services specified in paragraph 2(1) of Part III of Schedule 2 to the Act (no person to hold more than two licences for regional Channel 3) a person shall not at any time hold two licences to provide regional Channel 3 services if each of them is provided for London.

(2) In paragraph (1) the reference to London is a reference to the area of the United Kingdom in respect of which the Independent Television Commission have determined that a regional Channel 3 service is to be provided and which is, for the purposes of and by virtue of such determination, known as London.;

(2) (a) articles 1(4) and 4 shall be omitted;

(b)in article 2(1) “4,” shall be omitted; and

(c)in article 5(1) for the words “articles 3 and 4” there shall be substituted the words “article 3”.

Explanatory Note

(This note is not part of the Order)

This order amends the Broadcasting (Restrictions on the Holding of Licences) Order 1991 by substituting a new article 3 which has the effect of removing certain restrictions on the holding of two licences to provide regional Channel 3 services except where the services are provided for London, revoking article 4 which has now ceased to have effect and making consequential amendments.
