Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1), the Local Government Boundary Commission for Scotland on 10th March 1992 submitted to the Secretary of State a report on a review conducted under section 14(1) of that Act in which they made proposals for the transfer of a certain area from East Kilbride District to Eastwood District, both in Strathclyde Region, and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas; and whereas in exercise of the powers conferred on him by section 17(2) of the said Act, the Secretary of State made the Eastwood and East Kilbride Districts (Busby) Boundaries Amendment Order 1993(2) to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him; and whereas the date of coming into force of the said Order was 1st October 1993; and whereas East Kilbride District Council and Eastwood District Council have requested the Secretary of State to amend the date of coming into force of the said order and the Secretary of State is agreeable to that change; Now, therefore, in exercise of the powers conferred on him by sections 17(2) and 233(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the said proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Citation and commencement

1.—(1) This Order may be cited as the Eastwood and East Kilbride Districts (Busby) Boundaries Amendment (No.2) Order 1993.

(2) Article 6 of this Order shall come into force on 30th September 1993, but for all other purposes this Order shall come into force on 1st April 1994.

Interpretation

2.  In this Order–

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regulations 1977(3); and

“boundary map” means the map prepared by The Scottish Office marked “The Eastwood and East Kilbride Districts (Busby) Boundaries Amendment (No.2) Order 1993” and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a district boundary is a reference to such a boundary as it exists immediately before 1st April 1994.

Application of the 1977 Regulations

3.  Save insofar as they can have no application in relation to the area change effected by this Order, the provisions of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequence of, this Order.

Area Change

4.  That part of East Kilbride District which forms part of Busby in Strathclyde Region, being the area described in the Schedule to this Order and shown delineated and hatched on the boundary map, shall be transferred to Eastwood District in Strathclyde Region.

Consequential changes in electoral arrangements

5.  The area described in the Schedule to this Order (being the area transferred by article 4 of this Order)–

(a)shall cease to form part of electoral division 69 (Murray/Avondale) of Strathclyde Region(4) and of ward 15 (Avondale North) of East Kilbride District(5); and

(b)shall form part of electoral division 71 (Eastwood South) of Strathclyde Region and of ward 10 (Busby) of Eastwood District(6).

Revocation

6.  The Eastwood and East Kilbride Districts (Busby) Boundaries Amendment Order 1993(7) is hereby revoked.

Articles 2, 4 and 5

SCHEDULE

The area bounded by a line commencing at the point on the district boundary between City of Glasgow District and East Kilbride District at which the Kittoch Water meets the White Cart Water (Grid Reference NS 5807 5720), then generally eastwards along that district boundary to Kittoch Bridge (Grid Reference NS 5895 5691), then southwards along the centre line of the Kittoch Water to a point at Grid Reference NS 5908 5611, then southwestwards along the east face of the fence leading to the East Kilbride road (A726), then continuing across the said road to a point at Grid Reference NS 5903 5601, then westwards along the south side of that road to the point at which it meets the south side of the track to Busbyside Farm (Grid Reference NS 5881 5607), then southwestwards along that track to a point at Grid Reference NS 5873 5600, then southeastwards along a field boundary to the point at which it meets Thorntonhall Burn (Grid Reference NS 5885 5582), then generally southwestwards and northwestwards along the centre line of that burn to the point at which it meets the district boundary between East Kilbride District and Eastwood District at the White Cart Water (Grid Reference NS 5773 5572), then generally northwards along that district boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers on 1st April 1994 an area of approximately 166.095 hectares at Busby from East Kilbride District to Eastwood District both in Strathclyde Region and makes consequential changes to electoral arrangements.

This Order replaces the Eastwood and East Kilbride Districts (Busby) Boundaries Amendment Order 1993 (S.I. 1993/1312) so as to alter, at the request of both District Councils concerned, the date of coming into operation of the transfer of the said area at Busby from 1st October 1993 to 1st April 1994. This Order also revokes S.I. 1993/1312, but with effect on 30th September 1993.

The map annexed to and forming part of this note gives a general guide to the area affected by this Order.
