In exercise of the powers conferred upon me by section 22(4) of the Nurses, Midwives and Health Visitors Act 19791 and having satisfied myself that the Rules made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting and set out in the Schedule to this Order are framed in accordance with the recommendations of the Midwifery Committee of that Council2 in so far as they relate to midwifery practice,I hereby approve those Rules.

This Order may be cited as the Nurses, Midwives and Health Visitors (Entry to Examinations and Training Requirements) Amendment Rules Approval Order 1993 and shall come into force on 13th August 1993.

THE NURSES, MIDWIVES AND HEALTH VISITORS ACT 1979

The United Kingdom Central Council for Nursing, Midwifery and Health Visiting, in exercise of the powers conferred on it by sections 2(3) and (4), 11 and 22(1) of the Nurses, Midwives and Health Visitors Act 1979 and of all other powers enabling it in that behalf, having, in accordance with section 4(2) and 22(3) of that Act, consulted the Midwifery Committee, the National Boards and representatives of groups of persons likely to be affected by these Rules, hereby makes the following Rules:—

Citation and interpretation1

These Rules may be cited as the Nurses, Midwives and Health Visitors (Entry to Examinations and Training Requirements) Amendment Rules 1993.

In these Rules, unless the context otherwise requires—

a

“the principal Rules” means the Nurses, Midwives and Health Visitors Rules 19833;

b

“the 1990 Rules” means the Nurses, Midwives and Health Visitors (Midwives Training) Amendment Rules 19904.

Amendment of the principal Rules2

The principal Rules shall be amended in accordance with the following paragraphs of this Rule.

In rule 14 (nurse training rules), paragraph (3) shall be deleted.

In rule 19 (examinations), paragraphs (2), (2A), (2B) and (2C) shall be deleted.

In rule 30(1) (educational requirements)—

a

in sub-paragraph (d), the word “or” at the end shall be deleted;

b

in sub-paragraph (e), after the word “Council” there shall be inserted the word “; or” and the full stop shall be deleted;

c

after sub-paragraph (e) there shall be inserted the following sub-paragraph—

f

such vocational qualifications as the Council may, from time to time, approve as providing a standard of education appropriate to entry to such programmes of education.

Amendment of the 1990 Rules3

In rule 3 of the 1990 Rules (transitional provision), after the words “the principal Rules” there shall be inserted the words “, except sub-paragraph (4) of rule 35,”.

The Rules approved by this Order, and made by the United Kingdom Central Council for Nursing, Midwifery and Health Visiting, further amend the principal Rules approved by the Nurses, Midwives and Health Visitors Rules Approval Order 1983.

Rule 2 of these Rules deletes rule 14(3) of the principal Rules which makes provision in respect of the maximum number of times student nurses may enter a training course for entry to any of parts 1 to 8 of the register of nurses, midwives and health visitors (“the register”); amends rule 19 of the principal Rules respecting examinations so that the maximum number of times a student nurse may enter for examinations no longer applies; and inserts a new provision in rule 30(1) enabling the Council to accept vocational qualifications as educational entry requirements in relation to training of student midwives for entry to part 10 of the register.

Rule 3 of these Rules amends rule 3 of the Nurses, Midwives and Health Visitors (Midwives Training) Amendment Rules 1990 (transitional provision) so as to remove the provision relating to the maximum number of times student midwives who commenced their training before 1st September 1990 may enter midwifery examinations.
