Explanatory Note

(This note is not part of the Regulations)

1.  Section 63A(4) of the Road Traffic Regulation Act 1984 provides:

  • “Parking attendants in Greater London shall wear such uniform as the Secretary of State may determine when exercising prescribed functions, and shall not exercise any of those functions when not in uniform.”

2.  These Regulations prescribe functions for the purposes of that provision.

3.  One of the functions prescribed is the function of removing vehicles under section 99 of the Road Traffic Regulation Act 1984. The Removal and Disposal of Vehicles Regulations 1986 (S.I. 1986/183 as amended by S.I. 1993/1475) gives parking attendants certain powers to remove or arrange for the removal of vehicles which are parked in contravention of certain orders.

4.  Other functions are:

(a)the fixing and giving of penalty charge notices under section 66 of the Road Traffic Act 1991 as extended by section 77 of that Act; and

(b)the immobilisation of vehicles under section 69 or 77 of that Act.
