The Secretary of State, in exercise of the powers conferred upon him by section 15(1) and (2) of and paragraph 3 of Schedule 3 to the Health and Safety at Work etc.Act 1974(1) and of all other powers enabling him in that behalf and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Commission under section 11(2)(d) of the said Act after the carrying out by the said Commission of consultations in accordance with section 50(3) of that Act, hereby makes the following Regulations:
1. These Regulations may be cited as the Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) (Amendment) Regulations 1993 and shall come into force on 30th July 1993.
2. The Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) Regulations 1992(2) shall be amended as follows:
(a)in regulation 2(1)(a)—
(i)insert “(whether or not it is also radioactive material) or any radioactive material which is not at the same time a dangerous substance” after “substance”, and
(ii)insert “or, in the case of any radioactive material which is not also a dangerous substance, under the conditions set out in Schedules 1 to 4 to marginal 2704 of ADR” after “Schedule 2”;
(b)in regulation 2(3)—
(i)in sub-paragraph (a), insert “or radioactive material” after “substance” where that word occurs first and “or the radioactive material” after “vapour”, and
(ii)in sub-paragraph (b), insert “or radioactive material” after “substance” where that word occurs first, second and third and “or the radioactive material” after “vapour”;
(c)in regulation 4(1)(b), insert “and where the load being carried includes a dangerous substance” after “2(1)(a)”; and
(d)in Part I of Schedule 2—
(i)in the heading, insert “or radioactive material” after “substances”,
(ii)substitute a full-stop for the semi-colon and the word “or” at the end of sub-paragraph (d), and
(iii)delete sub-paragraph (e).

1. These Regulations amend the Road Traffic (Training of Drivers of Vehicles Carrying Dangerous Goods) Regulations 1992 (S.I.1992/744, amended by S.I.1992/1213).
2. The effect of the amendments is that drivers of certain road tankers carrying radioactive material and drivers of vehicles carrying certain tank containers containing radioactive material are obliged to possess the certificate of driver training required under Council Directive 89/684/EEC on vocational training for certain drivers of vehicles carrying dangerous goods by road (OJ No.L398, 30.12.89, p. 33).
1974 c. 37; sections 15(1) and 50(3) were amended by the Employment Protection Act 1975 (c. 71), Schedule 15, paragraphs 6 and 16(3) respectively.
