These Regulations require most local authorities, and certain other authorities, in England to publish the information specified in paragraph 8 of the Code of Recommended Practice for the Publication of Information About Unused and Underused Land Owned by Specified Local Authorities in England in the manner, form and on the occasions specified in the Code. The Code is set out in the Annex to the Department of the Environment Circular 18/89 which is obtainable from Her Majesty’s Stationery Office.
The Regulations (read with the Code) require each authority to compile and maintain a register of all unused or underused land in its ownership as at 31st March in each year. The register must contain information about the location of the land and its area, the nature of the legal interest held in the land and any legal constraints on its use, the current use of the land, the purpose for which the land is retained, and the total number of any empty dwellings on the land.
The authority is required, no later than 30th June each year, to make the register available at its principal office for inspection and copying by members of the public at all reasonable hours. The authority is also required, if requested by a member of the public, to make a plan of the land concerned so available.
