If a notified body is minded to refuse to issue an EC certificate of conformity under any of regulations 17, 18 and 19, it shall give the applicant the opportunity of making representations within a reasonable period as to why it should not be refused.

Where a notified body, having considered any representations made in accordance with paragraph (1) above, refuses to issue an EC certificate of conformity, it shall, in writing, inform the applicant of its decision and the grounds for its decision.
