The Secretary of State for Transport makes this Scheme in exercise of powers conferred by sections 16 and 326 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:—

1.  The M40 (London–Oxford) Motorway (Stokenchurch to Waterstock Crossroads Section) Scheme 1970(3)is hereby varied as follows:

(a)in Schedule 2, for the word “Three” there shall be substituted the word “Two”, and for the expression “A, B and C” there shall be substituted the expression “A and B”; and

(b)there shall be disregarded the heavy black line given the reference letter C on the deposited plan as defined in article 4.

2.  This Scheme shall come into force on 24th April 1992 and may be cited as theM40 (London–Oxford) Motorway (Stokenchurch to Waterstock Crossroads Section) Scheme 1970, Variation Scheme 1992.

Explanatory Note

(This note is not part of the Scheme)

This Scheme varies the M40 (London–Oxford) Motorway (Stokenchurch to Waterstock Crossroads Section) Scheme 1970 by removing the reference to the road connecting the A329 (previously known as the B4013) with the northbound carriageway of the M40 Motorway at Junction 7. The effect of the variation is that this connecting road ceases to be a special road as from the date on which the Scheme comes into force, but remains a trunk road for maintenance of which the Secretary of State for Transport is responsible.
