The Secretary of State, in exercise of the powers conferred on him by section 161 of the New Roads and Street Works Act 1991(1), and of all other powers enabling him in that behalf, hereby makes the following Order:
1.—(1) This Order may be cited as the Road Works (Notices) (Scotland) Order 1992 and shall come into force on 1st January 1993.
(2) In this Order—
“enactment” means any enactment passed or made before the commencement of section 161 of the New Roads and Street Works Act 1991 (not being a special enactment to which section 160(1), (2) or (3) of that Act applies).
2. Any notice given in compliance with any of the provisions of the Road Works (Registers, Notices, Directions and Designations) (Scotland) Regulations 1992(2) shall be deemed to satisfy any requirement made by or under any enactment or any instrument having effect under or by virtue of any enactment to give notice of any matter covered by said Regulations to the persons to whom that notice is required to be given by or under such enactment or instrument.

This Order provides that a notice given under the Road Works (Registers, Notices, Directions and Designations) (Scotland) Regulations 1992 shall satisfy the requirements of any enactment (other than a special enactment to which section 160(1), (2) or (3) of the New Roads and Street Works Act 1991 applies) with regard to the giving of notice of proposed road works.
