The Local Government Finance Act 1992 (Commencement No. 6 and Transitional Provision) Order 1992

The Secretary of State for the Environment, as respects England, and the Secretary of State for Wales, as respects Wales, in exercise of the powers conferred on them by sections 113(2) and 119(2) of the Local Government Finance Act 1992(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation

1.  This Order may be cited as the Local Government Finance Act 1992 (Commencement No. 6 and Transitional Provision) Order 1992.

Provisions coming into force on 2nd November 1992

2.  Paragraphs 6 to 8, 12 to 14, 26, 29, 30, 48, 50 to 52, 90 and 91 of Schedule 13 to the Local Government Finance Act 1992 shall come into force on 2nd November 1992.

Provisions coming into force on 1st April 1993

3.—(1) The following provisions of the Local Government Finance Act 1992 shall come into force on 1st April 1993—

(a)paragraphs 3 to 5, 32, 34, 57 and 58 of Schedule 13; and

(b)so much of Schedule 14 as relates to—

(i)section 81 (8A)

of the Education Reform Act 1988(2);

(ii)section 146 of, and paragraphs 2 to 18, 43, 49 to 54, 55(3), 56, 58, 59, 61, 63 to 65, 70, 71, 73, 74, 76(3), 77 and 78 of Schedule 5 and paragraph 98 of Schedule 11 to, the Local Government and Housing Act 1989(3);

(iii)the Community Charges (Substitute Setting) Act 1991(4).

Transitional provision

4.  Without prejudice to section 16(1) of the Interpretation Act 1978(5), the repeal of section 146 of the Local Government and Housing Act 1989 shall not affect any right of the Secretary of State to enforce, on or after 1st April 1993, any condition imposed as mentioned in subsection (5) of that section.

Explanatory Note

(This note is not part of the Order)

This Order provides for the commencement of certain provisions of the Local Government Finance Act 1992 (“the Act”) relating to England and Wales.

Article 2 brings into force on 2nd November 1992 paragraphs 6 to 8, 12 to 14, 26, 29, 30, 48, 50 to 52, 90 and 91 of Schedule 13 to the Act.

Article 3 brings into force on 1st April 1993 paragraphs 3 to 5, 32, 34, 57 and 58 of Schedule 13 and certain repeals in Schedule 14 to the Act.

Article 4 preserves the Secretary of State’s right to enforce conditions imposed on the payment of grant under section 146 of the Local Government and Housing Act 1989 notwithstanding the repeal of that section with effect from 1st April 1993 under article 3.
