The Education (Fees and Awards) (Amendment) Regulations 1991

Coming into force

The Secretary of State for Education and Science, in exercise of the powers conferred by sections 1 and 2 of the Education (Fees and Awards) Act 19831, hereby makes the following Regulations:–

Citation and commencement1

These Regulations may be cited as the Education (Fees and Awards) (Amendment) Regulations 1991 and shall come into force on 17th April 1991.

Amendment2

The Education (Fees and Awards) Regulations 19832 shall be amended as follows–

In schedule 2–

a

in paragraph 1(b) there shall be substituted for the words “accession to the European Community of the Kingdom of Spain and the Portuguese Republic” the words “unification of the Federal Republic of Germany”;

b

paragraph 2(2)(a)(ii) shall be deleted and the following substituted–

ii

(as respects any period prior to the unification of the Federal Republic of Germany) the former German Democratic Republic, and

c

in paragraph 5 there shall be substituted for the words “the Kingdom of Spain or the Portuguese Republic” in both places where they occur the words “or (as respects any period prior to the unification of the Federal Republic of Germany) the former German Democratic Republic”.

In paragraph 1 of Schedule 3 and paragraph 3(3)(a) and 5 of Schedule 4, there shall be substituted for the words “and (as regards any period prior to their accession to that Community) the Kingdom of Spain and the Portuguese Republic” the words “and (as respects any period prior to the unification of the Federal Republic of Germany) the former German Democratic Republic.”

These Regulations amend the Education (Fees and Awards) Regulations 1983 so that residence in the former German Democratic Republic prior to the unification of the Federal Republic of Germany is treated as residence in the European Community.
