In exercise of the powers conferred on the Secretary of State by section 1(2) of the Education (Student Loans) Act 1990(1), the Secretary of State for Education and Science hereby makes the following Regulations:

1.  These Regulations may be cited as the Education (Student Loans) (Amendment) Regulations 1991 and shall come into force on 17th April 1991.

2.  In paragraph 5 of the Schedule to the Education (Student Loans) Regulations 1990(2) for the definition of “European Community” there shall be substituted the following definition–

  • ‘European Community’ means the territory comprised by the member states of the European Community as constituted from time to time and, as respects any period prior to the unification of the Federal Republic of Germany, the former German Democratic Republic;.

Explanatory Note

(This note is not part of the Regulations)

These regulations amend the Education (Student Loans) Regulations 1990 by substituting a new definition of “European Community” which includes the former German Democratic Republic. The effect is that, for the purposes of eligibility for a loan, residence in that state prior to its unification with the Federal Republic of Germany is treated as residence in the European Community.
