The Social Security Act 1990 (Commencement No.3) Order 1991

8th March 1991

The Secretary of State for Social Security, in exercise of the powers conferred on him by section 23(2) of the Social Security Act 1990(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Social Security Act 1990 (Commencement No.3) Order 1991.

(2) In this Order, unless the context otherwise requires, references to sections and Schedules are references to sections of, and Schedules to, the Social Security Act 1990.

Appointed days

2.  The day appointed for the coming into force of—

(a) section 4 (computation of additional pension for purposes of invalidity pension etc.), is 6th April 1991;

(b) Schedule 6, paragraph 11 (tax years) and section 21(1) (minor and consequential amendments) in so far as it relates to it, is 6th April 1991;

(c) Schedule 6, paragraph 16 (statutory sick pay for NHS staff with divided contracts) and section 21(1) in so far as it relates to it, is 1st April 1991;

(d) Schedule 6, paragraph 22 (statutory maternity pay for NHS staff with divided contracts) and section 21(1) in so far as it relates to it, is 1st April 1991;

(e) Schedule 4, paragraph 10 (insurance companies with which occupational pension scheme benefits may be appropriately secured) and section 14(1) in so far as it relates to it, for the purposes only of authorising the making of regulations which are expressed to come into force on or after 4th November 1991, is 13th May 1991;

(f) Schedule 4, paragraph 10 in so far as it is not already in force, and section 14(1) in so far as it relates to it, is 4th November 1991.

Explanatory Note

This note is not part of the Order)

This Order provides for the coming into force of provisions of the Social Security Act 1990 on the following dates—

• 1st April 1991 for the provisions in—

  • Schedule 6, paragraph 16 relating to statutory sick pay for NHS staff with divided contracts,

  • Schedule 6, paragraph 22 relating to statutory maternity pay for NHS staff with divided contracts;

• 6th April 1991 for the provisions in—

  • section 4 relating to the computation of additional pension for purposes of invalidity pension,

  • Schedule 6 paragraph 11 relating to the definition of tax years;

• 13th May 1991 for Schedule 4, paragraph 10 in so far as relevant for the purpose of authorising the making of regulations and for all other purposes on 4th November 1991.
