The Community Charges and Non-Domestic Rating (Demand Notices) (Wales) (Amendment) (No.2) Regulations 1991

The Secretary of State for Wales, in exercise of the powers conferred on him by sections 140(4), 143(1) and (2) and 146(6) of, and paragraphs 1, 2(2)(1) and (1a) of Schedule 2 to,the Local Government Finance Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Regulations:

1.  These Regulations may be cited as the Community Charges and Non-Domestic Rating (Demand Notices) (Wales) (Amendment) (No.2) Regulations 1991, and shall come into force on 1st April 1991.

2.—(1) The Community Charges and Non-Domestic Rating (Demand Notices) (Wales) Regulations 1990(2) (“the principal Regulations”) shall have effect with the amendments prescribed in these Regulations.

(2) Expressions used in these Regulations which are also used in the principal Regulations shall have the same meaning as in those Regulations.

3.  Sub-paragraph [z] of paragraph 3 of Schedule 2 to the principal Regulations is hereby amended by adding at the end—

(iv)Where regulation 17(5) of the principal community charge regulations applies, the charging authority’s requirements for payment (determined in accordance with that provision) of the amount required to be paid under the notice.

4.  Sub-paragraph [z] of paragraph 6 of Schedule 2 to the principal Regulations is hereby amended by adding at the end—

(iv)Where regulation 17(5) of the principal community charge regulations applies, the charging authority’s requirements for payment (determined in accordance with that provision) of the amount required to be paid under the notice.

Explanatory Note

(This note is not part of the Regulations)

These Regulations apply to Wales. They make amendments to the Community Charges and Non-Domestic Rating (Demand Notices) (Wales) Regulations 1990 (S.I. 1990/293), in relation to a community charge demand notice issued after the end of the financial yearto which it relates, or after the chargepayer ceases to be shown on the community charges register. The amendments require the charging authority (in those circumstances) to include its requirements for payment in a prescribed place on the demand notice.
