CHANGES IN LOCAL GOVERNMENT AREAS

The Central and Tayside Regions and Clackmannan and Perth and Kinross Districts (Crook of Devon and Rumbling Bridge) Boundaries Amendment Order 1991

Whereas under section 17(1) of the Local Government (Scotland) Act 1973(1) the Local Government Boundary Commission for Scotland on 15th March 1988 submitted to the Secretary of State a report on a review conducted under section 14(1) of that Act in which they made proposals for the transfer of certain areas between Clackmannan District in Central Region and Perth and Kinross District in Tayside Region, and in which they also made proposals for changes in electoral arrangements consequential on those changes in local government areas;

Now, therefore, in exercise of the powers conferred on him by section 17(2) of the said Act, and of all other powers enabling him in that behalf, the Secretary of State hereby makes the following Order to give effect to the proposals of the Local Government Boundary Commission for Scotland as submitted to him:

Citation and commencement

1.  This Order may be cited as the Central and Tayside Regions and Clackmannan and Perth and Kinross Districts (Crook of Devon and Rumbling Bridge) Boundaries Amendment Order 1991 and shall come into force on 1st April 1991.

Interpretation

2.  In this Order—

“the 1977 Regulations” means the Local Government Area Changes (Scotland) Regulations 1977(2); and

“boundary map” means the map prepared by the Scottish Office marked “The Central and Tayside Regions and Clackmannan/Perth and Kinross Districts (Crook of Devon and Rumbling Bridge) Boundaries Amendment Order 1991 Map” and deposited in accordance with regulation 3 of the 1977 Regulations;

and, in the Schedule to this Order, any reference to a boundary of a region is a reference to a boundary existing immediately before the commencement of this Order.

Application of the 1977 Regulations

3.  Save, insofar as they can have no application in relation to the area changes effected by this Order, the provisons of the 1977 Regulations shall apply in relation thereto for the purposes of, or in consequences of, this Order.

Area changes

4.—(1) Those parts of Clackmannan District in Central Region, being the areas described in Part I of the Schedule to this Order and shown delineated, hatched and marked “Area A” and “Area C” on the boundary map, shall be transferred to Perth and Kinross District in Tayside Region.

(2) That part of Perth and Kinross District in Tayside Region, being the area described in Part II of the Schedule to this Order and shown delineated, hatched and marked “Area B” on the boundary map, shall be transferred to Clackmannan District in Central Region.

Consequential changes of electoral arrangements

5.—(1) The areas described in Part I of the Schedule to this Order (being the areas transferred by article 4(1) of this Order)—

(a)shall cease to form part of elecoral division 5 (Devonvale) of Central Region(3) and of ward 9 (Harviestoun) of Clackmannan District(4); and

(b)shall form part of electoral division 46 (Kinross) of Tayside Region(5) and of ward 28 (West Kinross) of Perth and Kinross(6).

(2) The area described in Part II of the Schedule to this Order (being the area transferred by article 4(2) of this Order)—

(a)shall cease to form part of electoral division 46 (Kinross) of Tayside Region and of ward 28 (West Kinross) of Perth and Kinross District; and

(b)shall form part of electoral division 5 (Devonvale) of Central Region and of ward 9 (Harviestoun) of Clackmannan District.

SCHEDULE

Part I

Area A on the boundary map

The area bounded by a line commencing on the Central/Tayside regional boundary at a point grid reference NO 0188 0164; in a generally southeasterly direction along the medium filum of the River Devon to a point grid reference NO 0256 0114; then westwards by the line of a field drainage ditch and then along the south side of an access track to a point grid reference NO 01740102; then southwards along the east side of an access track to a point grid reference NO 0188 0021; then westwards by field boundary fenceline to a point grid reference NO 0152 0014; then southwestwards by field boundary fenceline to the east side of the A823 road and southeastwards along the east side of the said road to its junction with the Class III road from Merryhills to The Leys at grid reference NT 0152 9985; then westwards along the south side of the said Class III road to a point grid reference NT 0090 9986; then southwards by field boundary dyke and fenceline to the south side of the public footpath leading to the property known as Blairhill Farm at a point grid reference NT 0094 9945; then northeastwards along the south side of the said footpath to a point grid reference NT 0103 9950; then generally southeastwards by field boundary dyke and fenceline to a point on the boundary grid reference NT 0128 9908; then northeastwards, eastwards, northeastwards, northwards and thereafter generally northwestwards along the said regional boundary to the point of commencement.

Area C on the boundary map

The area bounded by a line commencing on the Central/Tayside regional boundary at a point grid reference NO 0150 0180; in a westerly direction along the medium filum of the River Devon to a point on the said boundary grid reference NO 0107 0187; then eastwards along the said regional boundary to the point of commencement.

PART II

Area B on the boundary map

The area bounded by a line commencing on the Central/Tayside regional boundary at a point grid reference NO 0188 0164; in a northwestwards direction along the medium filum of the River Devon to rejoin the boundary at a point grid reference NO 0150 0180; then southeastwards along the said regional boundary to the point of commencement.

Explanatory Note

(This note is not part of the Order)

This Order transfers on 1st April 1991 three adjacent areas extending in total to approximately 251.5 hectares between Clackmannan District in Central Region and Perth and Kinross District in Tayside Region and makes consequential changes to electoral arrangements.

The map annexed to and forming part of this note gives a general guide to the areas affected by this Order.

Copies of the detailed boundary map defined in article 2 of this Order may be inspected at the offices of any of the local authorities referred to in this Order and may be inspected at or purchased from the Scottish Office Environment Department’s Map Library, New St Andrew’s House, Edinburgh, EH1 3SZ.
