This Order provides that section 8 of the Employment Act 1989 shall apply to certain special treatment for lone parents in the “Return to Work Programme” under which the National Council for One Parent Families is to provide training and other assistance to persons who wish to return to work. That section is to apply to special treatment which consists either of fixing special conditions for participation in the Programme or of making payments in respect of the care of a child of a lone parent while the lone parent is participating in the Programme.
Where section 8 of the 1989 Act applies to special treatment afforded to or in respect of lone parents then, by virtue of section 8(2), neither the treatment so afforded nor any act done in the implementation of such treatment is to be regarded for the purposes of the Sex Discrimination Act 1975 as giving rise to any discrimination falling within section 3 of the 1975 Act (which deals with discrimination against married persons for the purposes of the provisions in Part II of the 1975 Act).
