The Secretary of State, in exercise of the powers conferred on him by section 1(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, being of the opinion in accordance with section 1(1) of that Act that there exist or may exist circumstances which are likely to create a hazard to human health through human consumption of food and that in consequence food which is or may be in the future derived from sheep in the areas described in Schedule 1 to the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991(2), other than the areas described in those parts of that Schedule revoked by the following Order, is, or may be, or may become, unsuitable for human consumption, hereby makes the following Order:

Title and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) (Partial Revocation) Order 1991 and shall come into force on 11th December 1991.

Partial revocation

2.—(1) The Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 shall cease to have effect with respect to the areas numbered 12 and 13 of Schedule 1 to that Order and those parts of that Schedule which comprise the entries relating to those two areas are hereby revoked.

(2) In consequence of that revocation article 6(1)(a)(iv) and 6(1)(b)(iv) of that Order shall be amended by substituting for the words “10, 11, 12 and 13” the words “10 and 11”.

Explanatory Note

(This note is not part of the Order)

This Order partially revokes the Food Protection (Emergency Prohibitions) (Radioactivity in Sheep) (Wales) Order 1991 (“the principal Order”) which contains emergency prohibitions restricting various activities in order to prevent human consumption of food which has been or which may have been rendered unsuitable for that purpose in consequence of the escape of radioactive substances from a nuclear reactor situated at Chernobyl in the USSR.

The effect of the partial revocation is that two areas in Wales, both being in the County of Clwyd, are no longer subject to the restrictions set out in the principal Order.

Maps showing the areas which are designated by the principal Order and the areas derestricted by this Order are available for inspection during normal office hours at the offices of the Welsh Office Agriculture Department at Penrallt, Caernarfon, Gwynedd LL55 1EP; Government Buildings, Spa Road East, Llandrindod Wells, Powys LD1 5HA and Cathays Park, Cardiff, South Glamorgan CF1 3NQ.
