The Police and Criminal Evidence Act 1984 (Commencement No. 4) Order 1991

In exercise of the powers conferred on me by section 121 of the Police and Criminal Evidence Act 1984(1), I hereby make the following Order:

1.  This Order may be cited as the Police and Criminal Evidence Act 1984 (Commencement No. 4) Order 1991.

2.  The following provisions of the Police and Criminal Evidence Act 1984 shall come into force on the day following the date of making of this Order, namely–

(a)in those police areas specified in the Schedule to this Order, section 60(1)(b);

(b)section 60(2).

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 29th November 1991 section 60(1)(b) of the Police and Criminal Evidence Act 1984, in the police areas specified in the Schedule to the Order, and section 60(2). The effect is to require the Secretary of State to make an order requiring the tape-recording of interviews with suspects at police stations in those police areas in accordance with the code of practice issued by him (which, by virtue of S.I. 1988/1200, came into operation on 29th July 1988).

The entire Act is now in force with the exception of section 37(11) to (14) (and Schedule 13 to the Criminal Justice Act 1991 (c. 53) provides for the repeal of those subsections), and section 60(1)(b) in areas of England and Wales other than those mentioned in the Schedule to this Order.
