The A435 Trunk Road (South of Norton to Arrow) De-Trunking Order 1991

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The lengths of trunk road described in the Schedule to this Order and shown by broad striped hatching on the deposited plan shall cease to be trunk road and shall be classified as classified road as from the date on which the Secretary of State notifies the County Councils of Hereford and Worcester and Warwickshire that the new trunk road is open for through traffic.

2.  In this Order—

(1) All measurements of distance are measured along the route of the relevant highway;

(2) (i) “classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(ii)“the deposited plan” means the plan contained in the plan folio numbered HA10/2 WMRO LV marked “The A435 Trunk Road (South of Norton to Arrow) De-Trunking Order 1991” signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(iii)“the new trunk road” means the trunk road to be constructed by the Secretary of State in pursuance of the A435 Trunk Road (Norton—Lenchwick Bypass) Order 1991;

(iv)“the trunk road” means Bath — Lincoln Trunk Road (A435).

3.  This Order shall come into force on 29th November 1991 and may be cited as the A435 Trunk Road (South of Norton to Arrow) De-Trunking Order 1991.

SCHEDULELENGTHS OF TRUNK ROAD CEASING TO BE TRUNK ROAD

The lengths of trunk road ceasing to be trunk road are as follows:

1.  That length of the trunk road in the County of Hereford and Worcester from a point on the Evesham Bypass south of Norton, 190 metres east of the junction known as Twyford Roundabout, in a generally north easterly direction to the County Boundary, a distance of approximately 5.0 kilometres, as indicated by the letter “A” on the deposited plan;

2.  That length of the trunk road in the County of Warwickshire from the said County Boundary to its junction with the A422 (Worcester to Lincoln Trunk Road) at Arrow, a distance of approximately 6.9 kilometres, as indicated by the letter “B” on the deposited plan.
